\\r\\n In order to process applications to study in New South Wales (
NSW) government schools, it is\\r\\n necessary for the\\r\\n NSW Department of Education by its
DE International to collect certain personal data prior to\\r\\n your arrival in Australia\\r\\n via the Request for the AASES form and any subsequent related request for personal data (the\\r\\n
Requested Personal Data).
\\r\\n\\r\\n In some circumstances where DE International collects personal data in relation to an individual that\\r\\n is resident in\\r\\n European Union (
EU) at the time of collection, the EU General Data Protection Regulation\\r\\n (
GDPR) may apply under\\r\\n EU laws in addition to relevant laws in Australia. This form:
\\r\\n\\r\\n
\\r\\n - \\r\\n once completed reflects an acknowledgement by you of the purpose Requested Personal Data is\\r\\n collected for and additionally your consent regarding how DE international may use or process\\r\\n Requested Personal Data; but\\r\\n
\\r\\n - \\r\\n does not limit the rights of DE international or grant you any additional rights in relation to\\r\\n Requested Personal\\r\\n Data that is not the subject to the GDPR.\\r\\n

\\r\\n Providing your acknowledgement and consent in accordance with this form is voluntary, but failure to\\r\\n do so may\\r\\n delay or prevent DE International from processing the relevant application for study.\\r\\n

Purpose of Processing \\r\\n\\r\\n DE International may use the Requested Personal Data for one or more of the following\\r\\n purposes:

\\r\\n
\\r\\n - \\r\\n assessing the application for study in NSW against eligibility requirements, including:\\r\\n
\\r\\n - \\r\\n any eligibility requirements applying to international applicants; and\\r\\n
\\r\\n - \\r\\n for the level of schooling applied for;\\r\\n
\\r\\n
\\r\\n \\r\\n - \\r\\n information will be:\\r\\n
\\r\\n - \\r\\n provided to schools to arrange an enrolment;\\r\\n
\\r\\n - \\r\\n used to access data from the Australian Government’s Department of Home Affairs concerning\\r\\n the student visa: and\\r\\n
\\r\\n - \\r\\n provided to student exchange organisations (SEOs) to arrange accommodation and airport\\r\\n pick\\r\\n up services;\\r\\n
\\r\\n
\\r\\n \\r\\n - \\r\\n implementing any contract or pre-contractual measures at your request in relation to study\\r\\n opportunity; and\\r\\n

\\r\\n At any time, you are able to withdraw consent for DE International to process the Requested Personal\\r\\n Data, by\\r\\n contacting us here
here (
https://www.deinternational.nsw.edu.au/contact-us).\\r\\n Withdrawing your consent may prevent or\\r\\n delay DE International from processing the application for study or providing the study opportunity.\\r\\n If you withdraw\\r\\n consent (even where you no longer wish to apply for or have completed your study in NSW), it may still\\r\\n be necessary\\r\\n for DE International to retain and process your data for some of the purposes for which it was\\r\\n collected.\\r\\n
\\r\\n \\r\\n
Transfer of Personal Data outside of the European Union\\r\\n\\r\\n DE International is not based in the European Union and any Requested Personal Data provided will be\\r\\n transferred\\r\\n to and stored at a location in Australia for the purposes outlined above. You consent to this\\r\\n transfer and also\\r\\n acknowledge it is necessary (including to implement any contract or pre-contractual measures) in\\r\\n order for your\\r\\n application to be assessed and make the study opportunity that you have requested available.\\r\\n
\\r\\n You should be aware when providing your acknowledgement and consent to the transfer outside the EU\\r\\n under this form that:\\r\\n
\\r\\n
\\r\\n - \\r\\n the European Commission has not made an adequacy decision in respect of the privacy protections\\r\\n outlined\\r\\n above that will apply to the Requested Personal Data when stored in Australia and processed by\\r\\n DE\\r\\n International; and\\r\\n
\\r\\n - \\r\\n although the Requested Personal Data will be subject to the protections outlined above, these\\r\\n may not be\\r\\n 'appropriate safeguards' within the meaning of Article 46 of the GDPR.\\r\\n
\\r\\n
\\r\\n
\\r\\n This means that while DE International will comply with the requirements in NSW for protection of\\r\\n personal\\r\\n information, the Requested Personal Data will not be subject to the same rights for data subjects\\r\\n and obligations for\\r\\n controllers and processors of personal data as would apply in the European Union under the GDPR. The\\r\\n potential\\r\\n risks may include you not being able to access the same kind of legal rights and remedies that may\\r\\n otherwise be\\r\\n available within the EU if the GDPR applied. If you have any concerns regarding the level of\\r\\n protection given please\\r\\n contact DE International or the NSW Information and Privacy Commissioner for further information.\\r\\n

Declaration of acknowledgement and consent\\r\\n A person signing this form must not provide personal data to DE International unless they have the\\r\\n consent of the\\r\\n relevant individual the personal data relates to. Any persons under 18 years of age must obtain\\r\\n acknowledgement\\r\\n and consent to this form from a parent or legal guardian.\\r\\n
\\r\\n By signing this form I/we:
\\r\\n
\\r\\n - \\r\\n acknowledge that collection of the Requested Personal Data is necessary in order to process the\\r\\n application\\r\\n for study in NSW and for the other the purposes specified above;\\r\\n
\\r\\n - \\r\\n give free and informed consent for DE International (and the other third party processors listed\\r\\n on this form)\\r\\n to use the Requested Personal Data for the purposes listed above; and\\r\\n
\\r\\n - \\r\\n acknowledge it is necessary in order to process the application for study in NSW, and give free\\r\\n and\\r\\n informed consent to DE International, to transfer the Requested Personal Data from the European\\r\\n Union to\\r\\n Australia as set out in this form.\\r\\n
